Special provision —Liability
All customers who participate in our tours must behave in a good and orderly fashion and must abide by the instructions issued to him or her by or on behalf of the organiser of the event, lead tour guide and/or any competent authorities.
Any customer who participates in one of our tours does so at his or her own risk. Historical Amsterdam Tours is not responsible (and will not be liable) for any injury or damage incurred by a customer during one of our tours, or during the journey to or from the event.
Amsterdam Historical Tours will not be liable for any refusal by the organiser of an event, an establishment, or the public authorities to admit a customer to an event coordinated by, or through us,as a result of actions and/or negligence on the part of the customer.

Along with a brand new name and website, we welcome 2019 with a brand new privacy policy in accordance with (and in the spirit of) the General Data Protection Regulation (GDPR).

We are therefore committed to protecting and safeguarding the security and confidentiality of any personal data you share with us when you visit our Website or use our services.
What is the GDPR?
The GDPR, which became effective in May 2018, was enacted by the European Union (EU) to regulate the processing of personal data and for the protection of personal data. The GDPR applies to the processing of personal data (e.g. name, identification number, location data, online identifier, etc.) of data subjects (you, our customers) by a EU establishment (our company) whether or not the data subject (you again) is in the EU or is a EU citizen.
How do we use and process (and protect?) your personal data? (Modify as needed)
When you contact us via our website or via email to engage our services, there are certain types of basic information we ask for such as your name, email address, home address, telephone number, date of birth, preferred contact details, the names of those traveling with you, and payment information. You may also opt to provide special requests and preferences with respect to booking a particular tour, all of which is data we collect. In addition to this, we also collect information from your computer, phone, tablet or other device you are using to access our services. This includes the IP address, the browser you use, and your language settings. There are also situations in which we receive information about you from others or automatically collect other information.
The primary reason for requesting (and collecting) your personal details is to manage your tour booking, to ensure you get the best possible service, and to contact you regarding your tour booking or to inform you of our latest news, products and services.
We may invite you to submit a customer review after your tour with us, and we will collect information from you included in your reviews, including your display name and avatar if you choose one. By completing a customer review, you are agreeing that it can be displayed on our website, our mobile apps, on our social media accounts and social media apps. This is to inform other travelers about the quality of the tour you completed, the destination you have chosen or other experiences you choose to share.
We may collect and use personal information of children only as provided by the parent or guardian or with their consent. If we become aware that we process information of a child under 16 years old without the valid consent of a parent or guardian, we reserve the right to delete it.
We do not share your personal data with third parties except as required by applicable law, governmental or other authorities, or as necessary to provide you with our services, such as financial institutions and advertisers. We do not sell or rent your personal data.
We observe appropriate and adequate procedures to prevent unauthorized access to, and the misuse of, personal data that we process.
You always have the right to review the personal data we keep about you. You can request an overview of your personal data by emailing us to the email address stated below. You can also inform us of any changes to your personal data, or you can ask us to correct any of the personal data we hold about you but, as explained below, you may be able to make such changes yourself. You can ask us to erase, or block or restrict the processing of, the personal data we hold about you, or object to particular ways in which we are using your personal data. You can also ask us to send the personal data you have given us to a third party. Finally, where we are using your personal data on the basis of your consent, you are entitled to withdraw that consent at any time subject to applicable law.

(2)the legal basis that we have a legitimate commercial business interest in collecting your personal data to finalize the tour booking and provide customer service;

(4) when applicable, the legal basis of your freely given, specific, informed and unambiguous consent to collect and process your personal data.
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or statutory reporting requirements.
